General terms and conditions
1. THE CONTRACT
1-The contract will only be formalized with full agreement and mutual consent from both parties, acting in mutual interest. The contract is considered finalized when the lessee completes our form, reads and submits the form accepting the terms outlined here, and makes the agreed payment to our bank account.
2-The lessor rents the previously selected vehicle, whose model and color are specified in the contract. However, in justified cases, such as a potential vehicle breakdown, delayed service (minimum 60 minutes), or other situations deemed necessary by the company or to ensure the safety of the clients, we will provide a similar vehicle, which may differ in color or size, or we will arrange for another company to carry out the contracted services. If it is not possible to find another vehicle, the deposit paid will be refunded.
3-When the services are subcontracted to another company, the responsibility for the service will automatically transfer to the subcontracted company. If the lessee wishes to contact the subcontracted company, their details will be provided to the lessee.
4-Partybus Barcelona may organize and coordinate events and parties. Admission to nightclubs, venues, and restaurants is subject to their right of admission, and Partybus Barcelona will not be held responsible in any case.
If the previous steps are not completed, this contract will be considered canceled.
5-The person who completes this form is responsible for the service and must inform the clients/passengers accompanying them about the conduct rules in these general terms and conditions. If this conduct is ignored and damages occur, the lessee will be fully responsible for all repair costs, including the loss of use of the vehicle during the repair period.
6-This contract is considered read, accepted, and signed once the ‘Submit’ button is clicked after completing the form above.
2. VEHICLES
- For all the vehicles
- The driver is not obligated to call the client to inform them of their arrival at the location. The client is obligated to be at the chosen pick-up point at the chosen time, waiting for the vehicle to arrive.
- If the vehicle is waiting at the agreed location but the client is not there at the scheduled time, any time spent waiting will count as part of the client’s service time. (The client will be required to pay the full amount of the service) even if they arrive 59 minutes late.
- Music: We have a playlist on a USB with a bit of variety. If you want a different type of music or specific songs, you can connect your phone via a Jack cable or Bluetooth. Please note that there are some phone models that may not be able to connect to the radio. In this case, you can try another phone from your companion or continue with the music provided by the company.
- Limousines
- All limousines, whether large or small, have a maximum capacity of 8 occupants. If, in any service, there are more than the permitted 8 occupants, up to a maximum of 12, the company will not be held responsible for any actions by the police, such as forcing occupants over the limit to disembark. (In this case, those who are asked to leave will need to find their own way to the destination at their own expense), with no possibility of compensation or refunds from the company.
- If the vehicle is equipped with cameras, the image rights are exclusively for the company, to monitor potential misbehaviors, external thefts, etc. By making the deposit payment and completing this form, you consent and accept that the company Limohummer Jarque-Bentue has the right to the images from the service. The video will only be reviewed by the company, or by the police if necessary. 3 Partybus- Discounts
- Dancing by jumping or bouncing is prohibited on the bus. (It is a bus, not a nightclub.) Since we are driving on the street, we do not accept putting any occupant or people outside at risk.
- If the vehicle is equipped with cameras, the image rights are exclusively for the company, to monitor potential misbehaviors, external thefts, etc. By making the deposit payment and completing this form, you consent and accept that the company Minibuses Bon Helmer has the right to the images from the service. The video will only be reviewed by the company, or by the police if necessary.
3. PAYMENTS
1-An advance payment of a percentage of the service will be made to formalize the reservation. The remaining amount must be paid in cash before the service begins. If the remaining amount is not paid, the service will not start. In case of contract extension, the responsible person will be contacted to agree on the conditions.
2-The client must pay any costs arising from the breach of any of the clauses outlined here.
3-The payment for the reservation will be made via bank transfer or Bizum.
4. DAMAGES
1-Any damage to the vehicle, breakage of any element or decoration, burns from smoking, scratches, or dents, must be paid for with the repair invoice, as well as the cost of all services that the vehicle cannot perform due to being under repair. Alternatively, legal action may be taken through this contract.
2-Any damage caused to the vehicle, breakages, etc., must be paid by the person who caused the damage. If that person refuses to pay the repair estimate, the person responsible for renting the service must cover the cost, or legal action will be taken. (The person signing this contract must inform their companions of this potential situation.)
5. CANCELLATION
1-If the cancellation is made by the lessor, the company will not refund the initial reservation amount.
2-In case of cancellation by the company, the maximum amount refunded will be the costs already paid by the client. There is no right to compensation or any other derived rights.
3-In case of cancellation of an event by the client, the entrance fees to venues and parties cannot be refunded.
4-If, due to traffic or a breakdown, the service cannot be provided at the agreed time, the client will be informed and may choose either a refund of the paid amount or to reschedule the service. There is no right to compensation or any other derived rights.
5-In case of cancellation by the client one day before the service or on the same day of the service, the company may claim 50% of the outstanding service fee. In such cases, the client will be obligated to pay the 50% due for the improper cancellation, as it does not allow the company enough time to secure another reservation for that day and time.
6. IMAGE RIGHTS
1-Unless stated otherwise, image rights are considered accepted. Any images or videos taken by the drivers or vehicle attendants of the users on board will be exclusively for the purpose of showing other potential clients who may have doubts, posting on social media, or for possible promotions.
2-If any user does not want their image to be used on social media or for promotions, they must express this at the time.
7. THE ROUTE
1-The contracted company will adhere to the conditions agreed in the contract, where the pick-up and destination service conditions have been established, as long as the vehicle can comfortably access those streets.
However, the driver always has the final decision on which route to take, whether or not to enter a certain street, and whether to make a stop for photos, as these depend on various factors on the day and at that moment.
2-If any incident occurs during the journey that is unrelated to the company, the company will not be held responsible for any delays or other consequences resulting from it.
3-It must be taken into account that these are large vehicles with a very tight turning radius, and there are many streets we cannot access due to issues such as turns, poorly parked cars, narrow lanes, construction, etc.
8. USE OF THE VEHICLE AND PUBLIC ROADS
During the entire duration of the journey, the general traffic regulations apply to all passengers.
1-All passengers must be registered in advance, and under no circumstances will more people be taken than the vehicle’s authorized capacity. Each occupant of the vehicle is responsible for adhering to traffic regulations.
2-The instructions of the attendant or driver must always be followed. The driver and/or attendant is responsible for the well-being of the passengers and for ensuring that the service is carried out safely. The vehicles are equipped with sensitive, high-quality interior fittings, as well as technical devices.
3-It is strictly prohibited for passengers to open the doors or windows while the vehicle is in motion, throw objects out of the vehicle, extend body parts outside, or shout maliciously at people outside. In cases of dangerous behavior towards pedestrians or any part of the vehicle, the driver and/or attendant is obligated to stop the service and notify the police.
4-If you wish to operate any of the equipment yourself, it is necessary that our staff provide you with instructions first. It is very important that you receive guidance on how to use the devices.
The controls are available to you, and advanced handling requires specialized knowledge.
5-The rented vehicle will be used for the purpose it was contracted for, and not for any other use.
6-The client is responsible for complying with the rules set forth here, and is liable for any negligence in their use, as well as for the safety of the objects and people accompanying them.
9. IT IS PROHIBITED
1-The consumption of any type of drugs is strictly prohibited.
2-Smoking in the vehicles is strictly prohibited. If any incident occurs regarding this clause, the provisions outlined in Clause 4 of this contract will apply.
3-Food and drink are prohibited, unless previously arranged with the company.
4-The consumption of alcoholic beverages is prohibited for minors.
10. GENERAL PRINCIPLES AND COMPETENT JURISDICTION
For any disagreement or dispute that may arise regarding the interpretation or application of this contract, both parties submit to the jurisdiction of the courts of Barcelona, expressly waiving any other jurisdiction that may apply.
11. IMPORTANT CLAUSES
1-A different rate applies depending on time, location, distance, or any other factor related to the service. The prices on the website may vary as deemed appropriate by the company.
2-If the initially agreed time for the contracted service is exceeded, the same rate already paid for the service will apply again, with half the rate for 30 minutes or the full rate for one hour. 3-The rates established on the website or promotions are not valid for Christmas and New Year’s Eve. For these dates, please consult the rates.
4-The company will not be responsible for any items left behind by the client in the vehicle.
5-You must provide at least two street names for both the pick-up and drop-off locations. Otherwise, the driver will stop at the location he deems most appropriate. There are streets that the vehicles cannot access due to size, weight, or difficulty with turns. In such cases, the driver will stop at the location he considers most suitable, and the client will need to walk to the destination (the time will be deducted from the service for not providing a good location in advance).
6-In cases of misbehavior, disrespect, assaults, vomiting, or drunkenness, the driver may decide at any time to stop the vehicle and terminate the service (at any location). In this case, we are not responsible for any costs the client may incur for taxis, nor for any refund of the paid amount.
12. COMMITMENT
The vehicles undergo regular mechanical inspections and are up to date with the corresponding Technical Vehicle Inspection. However, the client agrees at the time of booking that there is a possibility that, due to force majeure circumstances not attributable to the company, the vehicles may experience a mechanical breakdown during the service. If this occurs, the company will provide a new vehicle of equal or higher category within a maximum of 2 hours from the time of the breakdown. If this is not possible, the company will refund the full amount paid by the client via bank transfer, regardless of the point in the service when the breakdown occurred, with no further claims from the client.
13. DATA PROTECTION CLAUSES
The data collected in this contract will be used in the manner, for the purpose, and within the limitations and rights established by Organic Law 15/1999, of December 13, on the Protection of Personal Data and its implementing regulations. The client will be able to exercise their rights in the manner established by the aforementioned law. Furthermore, such data may be transferred to third parties exclusively for the purpose of managing the services provided by this company, in the manner and with the guarantees established by the law.
